"Final Records, Petition for the Sale of the Amistad, September 17, 1840, U.S. Circuit Court, Connecticut" District of Connecticut Ss At a Circuit Court of the United States of America holden at Hartford within and for the District of Connecticut on the 17th day of September A.D. 1840 Present Hon: Smith Thompson Associate Justice of the Supreme Court of the United States Thomas R. Gedney & others v Schooner Amistad &c. Be it remembered, that at the present Term of this Court, William S. Holabird Esq the United States District Attorney for the District of Connecticut, appears in Court, and in behalf of the United States, files in this Court a representation and petition in the words and figures following to wit "District of Connecticut Circuit Court Septr Term 1840 The Subscriber would respectfully represent that the Schooner Amistad, and the goods which were found on board of her when she was brought within the jurisdiction of this Court and particularly described in the libel of Thomas R. Gedney & others, and in the apprisal [sic] of the apprisers of the same, and now in the custody of the Marshall of this District, the United States being claimants of the same and set forth in thier [sic] Libel, are in a perishable and ruinous condition: said Schooner needing extensive and immediate repairs, to keep her afloat, and said goods constant attention, to preserve them from a total loss, and unless said Schooner and said goods are disposed of, they will soon be of no avail to any one -- Therefore the Subscriber would pray your Honor to order a sale of said Schooner and said goods W.S. Holabird U.S. Dist. Atty And this Court having inquired into the allegations, set forth in said representation of said District Attorney doth find the same to be true -- It is therefore ordered & decreed by this Court, that the said Schooner Amistad, her tackle, apparel & furniture, & the goods which were found on board of her, & particularly described in the libel of Thomas R. Gedney & others, and in the apprisal [sic] of the apprisers of the same, and now in the custody of the Marshal of this District, be sold, by the Marshal of the said District, at public auction, to the highest bidder, at New London, in said District of Connecticut, on the 15th day of October A.D. 1840, he the said Marshall first giving reasonable notice of the time & place of such sale, by advertisement in the newspaper printed in New London in the District of Connecticut, & also by advertisement in a newspaper printed in the City of New York in the State of New York: and that said Marshal within ten days after such sale pay over the avails thereof into the hands of the Clerk of this Court: and that a Warrant issue accordingly Attest Chas.
