"Petition of Ariosa & Company, April 1845, U.S. Circuit Court, Connecticut"

To the Honorable Samuel Nelson, Associate Justice of the Supreme Court of the United States --

The Petition of Ariosa & Company of the city of Havana, merchants respectfully showeth --

That Ramon Bermejo, of Puerto Principe, Merchant, shipped on or about the 28th day of June 1839 on board of the Spanish Schooner Amistad, whereof Ramon Ferrer was master, bound to the port of Guanaja in the island of Cuba, the goods, and merchandize [sic] mentioned and particularly described in the invoice hereto annexed in the Spanish language -- That said Bermejo being the owner of said goods & merchandize duly sold, assigned and transferred to your petitioners the same together with all his rights, claims & demands in relation thereto.
That said Schooner Amistad having sailed from the said port of Puerto Principe on the said 28th day of June on her voyage aforesaid was captured by the United States Brig Washington [for] and taken from the custody of certain negroes who had mutineed and was brought into the District of Connecticut together with the cargo on board of said schooner -- That thereupon the commander and crew of said Brig Washington libelled the said schooner & her cargo for salvage, by reason whereof and of certain proceedings had at a Circuit Court of the United States holden at Hartford within & for the District of Connecticut on the 17th day of September A.D. 1840 the said schooner and her cargo were ordered to be sold at public auction and were thus sold on or about the 17th day of October 1840 agreably [sic] to said order, and in such sale were included the aforesaid goods & merchandize of your petitioners that were then remaining on board of said schooner --
And your petitioners further shew [sic] that at a Circuit Court of the United States of America holden at New Haven within and for the District of Connecticut on the last Wednesday of April 1841 an order was made that the balance of the proceeds of [sales] said sale of the cargo of said schooner which had not been claimed viz $972.04 should remain in the hands of the clerk of said Court subject to the future order of said Court; as by reference to the proceedings and records of said Court will more fully appear.

Your petitioners therefore pray that an order may be made directing the Clerk of this Court to pay to your petitioners or to their attorney the amount of said balance appertaining to your petitioners, or that such further or other order may be made in the premises as may be just and proper --
