Acting Secretary of State to the Chevalier de Argaiz.
DEPARTMENT OF STATE,
Washington, November 22, 1839.
Upon the receipt of the note addressed, on the 5th instant, to this department,
by the Chevalier de Argaiz, envoy extraordinary and minister plenipotentiary of Spain,
in relation to the arrest of Mr. Ruiz, in a civil suit against him before a court
of law in New York, the undersigned, acting Secretary of State, transmitted, by order
of the President, to the attorney of the United States for the district of New York,
directions again to inquire into the circumstances of the case, and to report his
opinion as to the authority of the United States Government to interfere in behalf
of Mr. Ruiz, for the purpose of procuring his release from imprisonment, as requested
by the Chevalier de Argaiz.

The undersigned, having received the report of the district attorney, hastens to communicate the enclosed copy of it to the Chevalier de Argaiz; and avails himself of this opportunity to offer him renewed assurances of his distinguished consideration.
